Serving Permanent Secretary from Jigawa state government, Mohammad Musa O. had been ordered to be arrested via bench warrant for not appearing for arraignment at the Code of Conduct Tribunal this morning.
While giving the order in Abuja, the Tribunal Chairman Hon Danladi Yakubu Umar, stated that the Accused person be produced by the code of Conduct Bureau on the 19thof January, 2016 for refusing to appear in today’s sitting after duly served with court notice by the court bailiff.
The prosecuting Counsel led by Musa Ibrahim Usman (Esq), said that the matter was adjourned for arraignment with bench warrant issued and was not effected neither revoked and the accused person was still absent.
Mr Ibrahim Musa sorted from the Tribunal to enforce the production of Mohammad Musa O. by means of bench warrant for not obliging himself to the court order.
However, the CCT Chairman insisted that the production of accused person before the court rests with the CCB, who is the only prosecuting agency to the Tribunal. He added that past practices by Tribunal to produce accused person, issued with bench warrant was discretionary on the part of CCT, not mandatory.
He therefore ordered the Code of Conduct Bureau to produce Mr Mohammad Musa O. on the 19th January, 2016 for arraignment.
The charged slammed against the serving permanent Secretary, Mohammad Musa O. by Code of Conduct Bureau, was contained in file No: CCT/JG/63/09, filed since 13thMarch 2013, signed by Peter Danladi (Esq) for Attorney General of the Federation.
Thus: ‘‘…on about the 7th day of August, 2006 being a public officer appointed as Permanent Secretary, office of the Head of Civil Service, Jigawa state failed to submit a written declaration of all your Assets and liabilities in Asset Declaration Forn CCB 1 at the beginning of your term in office within the prescribed period of three months and you thereby committed an offence contrary to paragraph 11 (1) of the Fifth Schedule, part 1of the Constitution of Federal Republic of Nigeria 1999 as amended and punishable by under paragraph 18 (1) and (2) of the same constitution.
